Terms of Service

0. Who we are

These Terms are between you (“Customer”, “you”) and Datanurd (“Datanurd”, “we”, “us”). Datanurd provides a self-serve analytics software platform and dashboards (“Services”), with optional onboarding guidance and technical support.

1. Scope of Services

Datanurd provides a subscription-based analytics platform that includes KPI dashboards, reporting, automation, and predictive insights (the “Services”).

The platform is primarily automated and self-serve. Customers receive access after purchase and complete onboarding to start using the product. Optional onboarding guidance and technical support may be available to help users understand features or resolve issues. No consulting or manual implementation is required to access core functionality.

2. Access & Credentials

You may be asked to connect third-party accounts (e.g., e-commerce platforms, analytics tools) so the Services can work. You retain ownership of your platforms and data. You are responsible for maintaining the confidentiality of your credentials and for revoking access on termination.

3. Data Ownership

You own your business data. We act as a data processor/service provider solely to provide the Services. We do not sell your data. We may use anonymized, aggregated learnings to improve our systems and internal benchmarking.

4. Data Security & Protection

We follow standard security practices such as least-privilege access, encryption in transit, secure secret handling, and controlled internal access. No system is 100% secure, but we take reasonable measures to protect your data.

5. Privacy & Compliance

We collect only what is necessary to provide the Services (business contact details, platform metadata, operational analytics data, and usage metrics). We do not sell data or create advertising profiles.

Where applicable, we follow common privacy principles and controls aligned with major privacy frameworks and laws, including GDPR (EU/EEA), UK GDPR, POPIA (South Africa), and applicable US and Australian privacy requirements. You are responsible for ensuring you have the right to share data with us and that your use of the Services complies with your obligations.

6. Pricing & Billing

Fees are charged monthly unless stated otherwise. Subscriptions renew automatically unless cancelled before the next billing cycle. Failed payments may result in suspension of access and/or Services until payment is resolved.

7. Refund Policy

14-day refund window (first-time purchases): Customers may request a refund within 14 days of their initial purchase.

Because customers receive immediate access to the platform and the Services begin upon purchase, refunds may be denied or prorated if the Services have already been used substantially or if optional onboarding support has already been provided within the 14-day window.

After the 14-day period, payments are non-refundable.

8. No Guarantees

We provide decision-support tools, not guaranteed outcomes. Forecasts and models are probabilistic and provided “as-is”. Final business decisions remain yours.

9. Limitation of Liability

To the maximum extent permitted by law, total liability is capped at the fees paid in the previous 3 months, and we are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

Either party may terminate in writing. On termination, access is removed and connected data pipelines stop; you should revoke credentials and remove connected accounts where applicable.

11. Governing Terms

These Terms are intended to be interpreted in a commercially reasonable manner and applied consistently with applicable consumer and business laws in the jurisdictions where the Services are offered, including (where applicable) the EU/EEA, the United Kingdom, the United States, Australia, and South Africa.
